Nestria ("we", "us", or "our") develops Android applications with a privacy-first approach. This Privacy Policy explains what information is — and is not — processed when you use our apps and visit www.nestria.io (the "Services").

1. Data controller

The data controller for the Nestria website and published Android applications is Nestria. You can contact us at contact@nestria.io.

2. Our privacy philosophy

We believe your personal data — especially your photos — belongs to you. Our apps are designed so that your content stays on your device and in cloud accounts you control. We do not operate servers that store your photos, personal media, or app usage profiles.

3. Information we collect

3.1 Our Android apps — we do not collect personal data

Nestria applications, including My Smart Gallery, do not collect, transmit, or store personal data on Nestria servers. Specifically, we do not collect:

• Name, email address, phone number, or other contact details
• Photos, videos, or other media files
• Contents of your cloud storage accounts
• Precise location history sent to Nestria (location embedded in photo metadata is processed on-device for map features)
• Device identifiers for advertising or cross-app tracking
• Usage analytics, crash reports sent to Nestria, or behavioral profiling data
• Payment or billing information (purchases, if any, are handled by Google Play)

Because we do not collect personal data through our apps, there is no Nestria database of users to access, export, or delete.

3.2 This website (www.nestria.io)

This website is a static publisher page. We do not use cookies, tracking pixels, fingerprinting scripts, or third-party analytics (such as Google Analytics) on this site.

Our hosting provider, Microsoft Azure, may process standard web server logs (such as IP address, browser type, requested URL, and timestamp) for operational, security, and abuse-prevention purposes. We do not use those logs to identify or profile individual visitors.

4. How our apps handle your data

4.1 My Smart Gallery

My Smart Gallery stores and processes your photos locally on your Android device. When you enable cloud backup or sync, your photos and app data are transmitted directly between your device and your personal cloud provider (such as Google Drive or Microsoft OneDrive). Nestria is not a party to that transfer and does not receive, store, or have access to your content.

4.2 Android permissions

My Smart Gallery may request Android permissions necessary for its features, such as access to photos and media on your device, network access for cloud sync, and storage management. Permissions are used only to provide app functionality on your device. We do not use them to collect data for Nestria.

4.3 Third-party SDKs and advertising

Our apps do not integrate third-party advertising networks or analytics SDKs that collect personal data for Nestria. We do not display ads based on your photo content or in-app behavior.

5. Legal bases (GDPR)

If you are in the European Economic Area (EEA), United Kingdom, or Switzerland, the following applies:

• Website hosting logs: Processed by our hosting provider on the basis of legitimate interest in operating a secure website (Article 6(1)(f) GDPR).
• App data on your device: Processed locally by you when you use the app. Nestria does not act as a controller of your photo library or cloud content.

6. Data sharing and sale

We do not sell, rent, or trade personal data. We do not share personal data with third parties for marketing purposes. The only sharing that may occur is between you and cloud providers you explicitly connect in the app.

7. International transfers

Nestria does not transfer personal data collected through our apps to third countries because we do not collect such data. If you use cloud providers, their data handling and international transfers are governed by their own policies.

8. Data retention and deletion

Data stored on your device or in your cloud account remains under your control. You can delete photos, uninstall the app, or revoke cloud access at any time. Uninstalling the app removes local app data from your device, subject to Android system behavior.

We do not retain copies of your personal content on Nestria systems.

9. Security

We design our apps to minimize data exposure. Cloud connections use the security mechanisms provided by your cloud provider and Android. No method of electronic storage or transmission is 100% secure; you are responsible for securing your device and cloud accounts.

10. Your rights

Depending on your location, you may have rights regarding personal data, including access, correction, deletion, restriction, portability, and objection. Because Nestria does not collect personal data through our apps, most requests relating to app usage should be directed to your cloud provider for data stored there, or managed locally on your device.

11. California privacy rights (CCPA/CPRA)

If you are a California resident: we do not sell or share personal information as defined by the California Consumer Privacy Act. We do not collect personal information through our apps for Nestria's own purposes. We do not use sensitive personal information for purposes beyond what is necessary to provide app features on your device.

12. Google Play Data safety

Our Google Play Data safety declarations reflect this policy: Nestria apps are designed not to collect user data for transmission to Nestria. Any data processed stays on the user's device or is sent directly to third-party cloud services the user chooses to connect.

13. Children's privacy

Our Services are not directed at children under 13 (or the minimum age required in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will take appropriate steps.

14. Changes to this policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page with an updated "Last updated" date. Material changes may also be communicated through app update notes where appropriate. Continued use of the Services after changes constitutes acceptance of the updated policy.
