Nestria ("we", "us", or "our") develops Android applications with a privacy-first approach. This Privacy Policy explains what information is — and is not — processed when you use our apps and visit www.nestria.io (the "Services").

1. Data controller

The data controller for the Nestria website and published Android applications is Nestria. You can contact us at contact@nestria.io.

2. Our privacy philosophy

We believe your personal data — especially your photos — belongs to you. Our apps are designed so that your content stays on your device and in cloud accounts you control. We do not operate servers that store your photos or personal media. We do use limited usage analytics (via Google) to understand how the Services are used, as described below.

3. Information we collect

3.1 Our Android apps

Nestria applications, including My Smart Gallery, do not store your photos, media, or account credentials on Nestria servers. We do not collect:

• Name, email address, phone number, or other contact details for a Nestria account
• Photos, videos, or other media files
• Contents of your cloud storage accounts
• Precise location history sent to Nestria (location embedded in photo metadata is processed on-device for map features)
• Device identifiers for advertising or cross-app advertising
• Crash reports via Crashlytics or similar crash-reporting products
• Payment or billing information (purchases, if any, are handled by Google Play)

Usage analytics: My Smart Gallery integrates Firebase Analytics (Google). The SDK auto-collects standard analytics events such as app opens and engagement metrics. We do not define custom analytics events in the app. We do not use other Firebase products (for example Crashlytics or Remote Config). Analytics data is processed by Google according to Google's terms and privacy documentation; Nestria does not operate its own analytics database of user profiles.

3.2 This website (www.nestria.io)

This website is a static publisher page. With your consent, we use Google Analytics 4 (measurement ID G-0105SMP6DH) to understand how visitors use the site (for example page views and approximate traffic). We do not use Firebase on this website.

Analytics cookies and related storage are set only after you click Accept on our cookie banner. If you Decline, Google Analytics is not loaded. You can change your choice anytime via Cookie preferences in the site footer. We store your consent choice in your browser's local storage.

Our hosting provider, Microsoft Azure, may process standard web server logs (such as IP address, browser type, requested URL, and timestamp) for operational, security, and abuse-prevention purposes. We do not use those logs to identify or profile individual visitors.

4. How our apps handle your data

4.1 My Smart Gallery

My Smart Gallery stores and processes your photos locally on your Android device. When you enable cloud backup or sync, your photos and app data are transmitted directly between your device and your personal cloud provider (such as Google Drive or Microsoft OneDrive). Nestria is not a party to that transfer and does not receive, store, or have access to your content.

4.2 Android permissions

My Smart Gallery may request Android permissions necessary for its features, such as access to photos and media on your device, network access for cloud sync, and storage management. Permissions are used to provide app functionality on your device. Network access is also used by Firebase Analytics to send auto-collected usage events to Google.

4.3 Third-party SDKs and advertising

Our apps do not integrate third-party advertising networks. We do not display ads based on your photo content or in-app behavior.

For analytics only: Android apps use Firebase Analytics; this website uses Google Analytics 4 (after consent). We do not use other Firebase products in the apps. Google's processing of analytics data is governed by Google's applicable terms and privacy policies.

5. Legal bases (GDPR)

If you are in the European Economic Area (EEA), United Kingdom, or Switzerland, the following applies:

• Website Google Analytics: Processed on the basis of your consent (Article 6(1)(a) GDPR). You may withdraw consent at any time via Cookie preferences without affecting the lawfulness of processing before withdrawal.
• Website hosting logs: Processed by our hosting provider on the basis of legitimate interest in operating a secure website (Article 6(1)(f) GDPR).
• App Firebase Analytics: Usage analytics are processed via Google to understand and improve the app. Depending on your region and device settings, this may rely on legitimate interest (Article 6(1)(f) GDPR) and/or consent mechanisms provided by the Google Play ecosystem and Android. You can limit analytics through Android and Google account privacy settings where available.
• App data on your device: Your photo library and cloud content are processed locally by you when you use the app. Nestria does not act as a controller of that content.

6. Data sharing and sale

We do not sell, rent, or trade personal data. We do not share personal data with third parties for advertising or marketing purposes.

We share limited usage analytics with Google as described in this policy (Firebase Analytics in our apps; Google Analytics 4 on this website after consent). Cloud providers you explicitly connect in the app receive data you choose to sync under their own terms.

7. International transfers

Analytics data processed by Google may be transferred to and stored in countries outside your residence, including the United States, subject to Google's safeguards and applicable transfer mechanisms. If you use cloud providers, their international transfers are governed by their own policies. Nestria does not operate servers that store your photos.

8. Data retention and deletion

Data stored on your device or in your cloud account remains under your control. You can delete photos, uninstall the app, or revoke cloud access at any time. Uninstalling the app removes local app data from your device, subject to Android system behavior.

We do not retain copies of your personal content on Nestria systems. Website and app analytics data are retained according to the retention settings configured in Google Analytics / Firebase Analytics (Google's defaults apply unless we configure a shorter period).

Your website cookie consent preference is stored in your browser until you clear site data or change your preference.

9. Security

We design our apps to minimize data exposure. Cloud connections use the security mechanisms provided by your cloud provider and Android. No method of electronic storage or transmission is 100% secure; you are responsible for securing your device and cloud accounts.

10. Your rights

Depending on your location, you may have rights regarding personal data, including access, correction, deletion, restriction, portability, and objection. For photos and cloud content, manage data locally on your device or with your cloud provider.

For website analytics, withdraw consent via Cookie preferences in the footer. For questions about analytics or other privacy requests related to Nestria, contact contact@nestria.io. You may also use tools and rights available through Google for data processed in Google Analytics / Firebase. You have the right to lodge a complaint with your local data protection authority.

11. California privacy rights (CCPA/CPRA)

If you are a California resident: we do not sell personal information for monetary consideration, and we do not share personal information for cross-context behavioral advertising. We do not use advertising SDKs. Limited usage analytics are processed by Google as described in this policy. We do not use sensitive personal information for purposes beyond what is necessary to provide app features on your device and the analytics described here.

12. Google Play Data safety

Our Google Play Data safety declarations are intended to reflect this policy: Nestria apps do not collect your photos for transmission to Nestria. Photos stay on your device or are sent directly to cloud services you choose. The apps collect app activity / analytics data via Firebase Analytics (auto-collected by Google), which should be declared accordingly in Play Console.

13. Children's privacy

Our Services are not directed at children under 13 (or the minimum age required in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will take appropriate steps.

14. Changes to this policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page with an updated "Last updated" date. Material changes may also be communicated through app update notes where appropriate. Continued use of the Services after changes constitutes acceptance of the updated policy.
